1. Acceptance of Terms

By accessing or using Companionly, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our service. We reserve the right to modify these terms at any time, and your continued use of the service constitutes acceptance of any changes.

2. Eligibility

You must be at least 18 years of age to use Companionly. By using our service, you represent and warrant that you meet this requirement. We reserve the right to terminate accounts belonging to users who misrepresent their age or eligibility.

3. Nature of the Service

Companionly is a companionship platform that connects individuals with vetted companions for social interaction, friendship, and emotional support. Our service is not a dating platform, escort service, or therapeutic service. Any romantic or intimate relationships that develop are solely between consenting adults and are not facilitated or endorsed by Companionly.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when registering and to keep your profile up to date. You must notify us immediately of any unauthorized use of your account.

5. Prohibited Conduct

You agree not to use our service to harass, threaten, or harm any companion or other user; share false, misleading, or deceptive information; solicit sexual services or engage in any illegal activity; attempt to circumvent our platform to avoid service fees; or scrape, hack, or interfere with our systems. Violations may result in immediate account termination.

6. Companion Verification

All companions on our platform are verified through Facebook and a manual review process. However, Companionly does not guarantee the accuracy of companion-provided information or the outcome of any interaction. Users are encouraged to exercise their own judgment and to report any concerns to our support team.

7. Payments and Refunds

Service fees are charged as described on our pricing page. All payments are processed securely through our payment providers. Refunds may be issued at our discretion in cases of service failure or verified misconduct. We reserve the right to change pricing with reasonable notice.

8. Limitation of Liability

Companionly is not liable for any indirect, incidental, special, or consequential damages arising from your use of our service. Our total liability to you for any claims arising from these terms shall not exceed the amount you paid us in the three months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms, harmful conduct, or at our sole discretion. You may also delete your account at any time through your account settings. Termination does not relieve you of any obligations incurred prior to termination.

10. Governing Law

These Terms of Service are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in New York County.
